General Conditions

  1. All advertising is subject to the Publisher's approval.  The Publisher reserves the right to reject advertising which it feels is not in keeping with the publication's standards and to place the word "advertisement" with material that, in the Publisher's opinion, resembles editorial matter.  National School Boards Association publications conform to the standards of the American Society of Magazine Editors for narrative advertising material.
  2. Advertising is sold only at earned, published rates.  Frequency rates must be earned within 12 consecutive months, starting with the first insertion.  Advertising rates listed reflect a per insertion charge.
  3. Advertisements are accepted upon the representation that the advertiser and its agency have the right to publish the contents thereof.  In consideration of such publication, the advertiser and its agency agree to indemnify and hold Publisher harmless against any expense or loss by reason of any claims arising out of publication.
  4. Conditions, other than rates, are subject to change by Publisher without notice.
  5. Positioning of advertisements is at the discretion of the Publisher except where a request for a specific preferred position is acknowledged by Publisher in writing.
  6. Publisher shall have no liability for errors in key numbers.
  7. All insertion orders are accepted subject to provisions of our current rate card.  Rates are subject to change on notice from the Publisher.  Should a change in rates be made, space reserved may be canceled by the advertiser or its agency at the time the change becomes effective without incurring short-rate charges.  Cancellation of space reservations for any other reason in whole or part by the advertisers will result in an adjustment of the rate (short-rate) based on past and subsequent insertions to reflect actual space used at the earned frequency or volume rate.
  8. Publisher shall not be liable for any costs or damages if for any reason it fails to publish an advertisement.
  9. Publisher shall have the right to hold the advertiser and/or its advertising agency jointly and severally liable for such monies as are due and payable to the Publisher for advertising which the advertiser or its agent ordered and which advertising was published.
  10. No conditions other than those set forth in this rate card shall be binding on the Publisher unless specifically agreed to in writing by the Publisher.  Publisher will not be bound by conditions printed or appearing on order blanks or copy instructions which conflict with provisions of this rate card.
  11. Publisher is not liable for delays in delivery and/or non-delivery in the event of an act of God, action by any government or quasi-government entity, fire, flood, insurrection, riot, explosion, embargo, strikes whether legal or non-legal, labor or material shortage, transportation interruption of any kind, work slowdown, or any condition beyond the control of Publisher affecting production or delivery in any manner.
  12. As used in this section entitled "General Conditions," the term "Publisher" shall refer to the National School Boards Association.
  13. Agency Commissions: 15% gross of billing on regular run-of-book advertising is allowed to recognized agencies on space, color, and position, if the account is paid within 30 days of invoice.  In the event of nonpayment, Publisher reserves the right to hold advertiser and/or its agency jointly or separately liable for such monies as are due and payable to Publisher.  No cash discounts. Production and mechanical charges are not commissionable.  No agency commission will be paid on inserts.  No agency commission will be paid on online insertion orders.
  14. These conditions also apply to special reports and other publications produced by the National School Boards Association.
  15. Publisher assumes no responsibility for errors resulting from materials not supplied to required specifications.
  16. Publisher reserves the right to charge back to advertisers any printer's charges that result from materials not meeting specifications.
