    The Department of Education (ED) has issued guidance for school officials on the Family Educational Rights and Privacy Act (FERPA) and H1N1.     The Department of Education (ED) has released the final priorities, requirements, definitions and selection criteria for the $4.3 billion Race to the Top Fund. A competitive grant program, the Fund will benefit states that have raised student achievement in the past and have the capacity to continue to do so through implementing innovative education reform strategies around the four areas of education reform outlined in the American Recovery and Reinvestment Act of 2009 (ARRA).

    The Department of Education (ED) will hold a series of public meetings to learn from assessment experts and practitioners. The Secretary of Education (Secretary) is holding these meetings in order to seek input relating to the development of a Race to the Top Assessment Competition.

    The Department of Education (ED) has released details about the proposed priorities, requirements, and selection criteria for the $650 million Investing in Innovation, or i3, fund.     US Ed has issued its annual notice to SEAs and LEAs of their responsibilities under the Family Educational Rights and Privacy Act (FERPA) and the Protection of Pupil Rights Amendment (PPRA).
  • Guidance on flexibility and waivers for SEAs, LEAs, postsecondary institutions, and other grantee and program participants in responding to pandemic influenza (H1N1 Virus) html type content icon [HTML 1,482kb]
    The US Department of Education has issued guidance that discusses waivers from federal education requirements that may provide state or local educational institutions with the operational flexibility necessary to efficiently close schools and otherwise respond to the administrative challenges presented by a potential H1N1 outbreak such as: prolonged school closures, excessive absenteeism, or other disruptions in the regular delivery of educational services to students for a prolonged period of time.

    New School improvement grants will be issued to help low performing schools nationwide. In order to identify which schools and LEA’s most need these funds, the Secretary of Education will require each State Education Agency (SEA) to identify three tiers of Title I schools.

    The Department of State (DOS) has issued an advance notice of proposed rulemaking (ANPRM) seeking information on alternative and more specific means of screening potential host families of foreign exchange students.

    U.S. Secretary of Education Arne Duncan has sent a letter to all chief state school officers encouraging each state to review their current policies and guidelines regarding the use of restraints and seclusion techniques in schools and if appropriate develop or revise them to ensure the safety of students.

    The U.S. Department of Education (ED) has (1) issued draft guidance regarding waivers under ARRA of certain NCLB requirements, of Title I, Part A rules, and of “maintenance of effort” (MOE) rules; (2) issued guidance on stimulus funding and MOE requirements under Part B of the Individuals with Disabilities Education Act (IDEA); and (3) announced a series of technical assistance web conferences on ARRA implementation.
  • FTA withdraws controversial proposed rule on bus routes, for now html type content icon [HTML 2,368kb]
    The Federal Transit Administration (FTA) has withdrawn its proposed rule on school bus operations because of a “public misperception” that FTA was attempting to restrict opportunities for grantees, when according to FTA, it was attempting to allow grantees to provide service historically allowed.
  • EEOC issues guidance on discrimination against employees with caregiving responsibilities html type content icon [HTML 1,259kb]
    The Equal Employment Opportunity Commission (EEOC) has issued a technical assistance document entitled Employer Best Practices for Workers with Caregiving Responsibilities, which supplements a 2007 guidance document, Unlawful Disparate Treatment of Workers with Caregiving Responsibilities, that examined how federal anti-discrimination laws apply to workers with caregiving responsibilities.

    As part of a new air toxics monitoring initiative, the Environmental Protection Agency (EPA), state, and local air pollution control agencies will monitor the outdoor air around selected schools for toxic air pollutants.

    The Department of Health and Human Services (HHS) has issued a proposed rescission of its December 2007 final rule that would have prohibited federal reimbursement for Individuals with Disabilities Education Act (IDEA)-related administrative and transportation costs for Medicaid-eligible students.

    The Internal Revenue Service (IRS) has issued a draft revenue procedure which establishes a pre-approval program of prototype plans under 403(b).

    The American Recovery and Reinvestment Act of 2009 provides for a 65% reduction in Consolidated Omnibus Budget Reconciliation Act (COBRA) premiums for up to nine months for those eligible for COBRA coverage who are involuntarily terminated between September 1, 2008, and December 31, 2009.

    The Department of Labor (DOL) has created a website that includes frequently asked questions for employers about the Consolidated Omnibus Budget Reconciliation Act (COBRA) premium reduction under the American Recovery and Reinvestment Act of 2009 (ARRA), as well as COBRA AARA model notices.

    Notice 2008-62 describes regulations IRS intends to propose under § 409A which will make the requirements of § 409A not apply to public school employees who work over 10 months and are paid over 12 months in most instances.

    The Centers for Medicare & Medicaid (CMS) of the Department of Health and Human Services has issued a final rule eliminating federal Medicaid payment for the cost of certain school-based administrative and transportation activities.

    Based on the results of a bus research program detailed in a 2002 National Highway Traffic Safety Administration (NHTSA) report that examined ways to further improve school bus safety, the Department of Transportation (DOT) is proposing several upgrades to the school passenger crash protection requirements.
